Divorce is a painful process which involves the process of deciding who gets the house when real estate is involved, whether it be your own home or rental property that is owned together. In a divorce situation typically the home is either sold or one party stays in the house and the other party buys out the other. In either case both parties should have a real estate appraisal completed for each property.

Typically the attorney’s involved with handling the divorce will make sure a real estate appraisal is completed in order to determine the Fair Market Value for each property involved. The appraisal report will usually be completed as of the divorce or filing date which means the appraisal report will be a “retrospective appraisal” – an effective date that matches the divorce or filing date.
